Welcome to www.bandtogethersc.com (the “Site”), operated by Band Together, Inc (“Band Together,” “we,” “our,” or “us”). By accessing or using the Site, purchasing tickets, making a donation, or submitting forms, you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Site.
1) About Band Together
Band Together is a community-driven organization that produces benefit events and fundraising initiatives to support access to music education and related charitable purposes. Information on the Site is provided for general informational and fundraising purposes.
2) Changes to These Terms
We may update these Terms at any time. Changes will be posted on this page with an updated Effective Date. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
3) Ticket Sales and Event Transactions
A. Ticketing platform
Tickets may be sold through TicketSpice, a third-party ticketing provider. Ticket purchases are processed through TicketSpice and are subject to these Terms and TicketSpice’s applicable terms and policies.
B. Donations
Donations may be processed through Stripe, a third-party payment processor. Stripe’s terms and policies apply to payment processing. Band Together does not store full payment card information on its servers.
C. Accuracy of information
You agree to provide accurate and complete information for purchases, donations, and forms. You are responsible for maintaining the confidentiality of your order confirmation and/or ticket QR code.
4) Refunds, Cancellations, and Postponements
Ticket purchases are subject to our Refunds & Cancellations Policy, which is incorporated into these Terms by reference. In summary:

If an event is cancelled, full refunds will be issued.

If an event is postponed, tickets remain valid for the new date.

Refunds are only issued if the event is cancelled, except that a partial refund may be available if you cannot attend the postponed date and request it no later than 4 business days prior to the rescheduled event (subject to the Refunds & Cancellations Policy).
5) Event Policies and Venue Rules
Attendance at Band Together events is subject to our Event Policies (including entry rules, bag policy, prohibited items, code of conduct, and safety screening) and any venue rules. Event Policies are incorporated into these Terms by reference. We reserve the right to refuse entry or remove any person for policy violations, unsafe conduct, or non-compliance with staff instructions, without refund.
6) Intellectual Property
All content on the Site—including text, graphics, logos, photos, videos, and design—is owned by Band Together or used with permission and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without written permission, except for personal, non-commercial use such as sharing official posts or links.
7) Acceptable Use
You agree not to:

attempt to gain unauthorized access to the Site or its systems

interfere with or disrupt the Site’s operation

submit false, misleading, or fraudulent information

upload or transmit malware or harmful code

8) User Submissions
If you submit information through forms (contact, sponsorship, volunteer, etc.), you grant Band Together the right to use that submission to respond to you and administer programs and events. You represent that your submission is accurate and does not violate the rights of any third party.
9) Links to Third Parties
The Site may contain links to third-party websites or services (including TicketSpice and Stripe). We do not control and are not responsible for the content, policies, or practices of third parties. Access and use of third-party services is at your own risk.
10) Disclaimers
The Site and its content are provided “as is” and “as available.” We make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
11) Limitation of Liability
To the maximum extent permitted by law, Band Together and its directors, officers, volunteers, agents, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, ticket purchases, donations, or event attendance. Our total liability for any claim will not exceed the amount you paid to Band Together for the specific transaction giving rise to the claim.
12) Indemnification
You agree to defend, indemnify, and hold harmless Band Together and its directors, officers, volunteers, agents, and partners from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of the Site, or violation of any law or third-party rights.
13) Privacy
Your use of the Site is also subject to our Privacy Policy, which is incorporated into these Terms by reference.
14) Tax Deductibility
Donations may be tax-deductible to the extent allowed by law. Band Together does not provide tax advice. Consult your tax professional regarding deductibility. Ticket purchases are generally not tax-deductible.
15) Governing Law and Venue
These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles. Any dispute arising under these Terms shall be brought in the state or federal courts located in South Carolina, and you consent to their jurisdiction.
16) Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
